The present General Terms and Conditions (hereinafter: T&C) define the terms of sale and related legal relations (hereinafter: Contract) concluded between the Keleti Real Hospitality and Art Services Limited Liability Company (hereinafter: Service Provider) and any customer ordering any product (hereinafter: Product) from the webshop available on the website http://www.madhousebudapest.hu (hereinafter: webshop). By placing an order from our webshop, you also accept the provisions of this T&C.

Where this T&C refers to the Consumer, it only includes a consumer as defined by Section 8:1 of the Civil Code, Paragraph 3. The term Customer includes both the Consumer and business entities as defined by Section 8:1 of the Civil Code, Paragraph 4.

Products

The range of products sold in the webshop by the Service Provider includes:

  • Tickets for events (hereinafter: Ticket),
  • Packaged food that does not require refrigeration,
  • Alcoholic beverages (hereinafter: Alcoholic Product),
  • Merchandising items (e.g., T-shirts, mugs),
  • Handcrafted products (e.g., ceramics),
  • Plants,
  • Wine/beer.

The Ticket is not personalized, can be freely transferred, but cannot be refunded.

Voucher usage: valid for six months from issuance, not redeemable for cash or products, and may only be used for food and beverage consumption.

Handling Complaints

The Consumer may submit complaints regarding the Product or the Service Provider’s activities at the following contact information:

The Service Provider will handle complaints following the provisions of the Consumer Protection Act (1997, Act CLV). In case of a consumer dispute, the Consumer has the right to:

  • Initiate proceedings with the Consumer Protection Authority,
  • Enforce their rights through court proceedings,
  • Initiate proceedings with the relevant Arbitration Board (www.bekeltetes.hu).

Reseller Provisions

The resale or distribution to third parties of the products purchased from the webshop (including handcrafted items) is prohibited unless an explicit written agreement has been made with the Service Provider.

Contract Conclusion

The information displayed on the website does not constitute an offer by the Service Provider to enter into a contract. The offer is submitted by the Consumer by finalizing and submitting the order. The Customer is bound by their offer for a period of 48 hours. If the offer is not confirmed within 48 hours, the offer binding ceases. The Contract is concluded when the Service Provider confirms the order via email.

The Service Provider only sells Alcoholic Products to persons over the age of 18, and by accepting the T&C, the Customer declares they are over 18 at the time of contract conclusion.

The content of the contract between the Service Provider and the Customer is defined by this T&C. The Contract is not considered a written contract, and it is not registered by the Seller.

The Contract is governed by Hungarian law, and any dispute arising from the Contract shall be subject to the exclusive jurisdiction of the Hungarian courts.

Prices are indicated in Hungarian forints (HUF), including a 27% VAT, but do not include delivery costs. By concluding the Contract, the Customer agrees to bear the delivery costs. Prices are for informational purposes, and the Service Provider reserves the right to change prices.

The Service Provider reserves the right to correct any incorrect price or other parameter in the order confirmation, notifying the Consumer of the correction promptly. In this case, the Customer may accept the modified terms or withdraw from the Contract without any further obligation.

The Service Provider retains ownership of the Product until the purchase price is paid in full; however, the risk of damage passes to the Customer upon delivery.

Delivery and Receipt of Products

The Product will be delivered to the pickup location specified by the Customer with the assistance of a courier service. The delivery location is the geographic location specified by the Customer within the options offered by the webshop. If the customer chose in-store pickup, they have 2 weeks (14 days) to collect their package. After this period, the order will be canceled.

Unless otherwise stated in this T&C, the Seller guarantees delivery of the ordered products within Hungary. For purchases outside Hungary, an individual agreement is required between the Service Provider and the Customer.

If Alcoholic Products are included in the Products, the courier will verify that the recipient is over 18 years old. If the recipient cannot prove their age with an official ID, the courier will refuse delivery, and the Product will be returned to the sender. Any additional costs in this case will be borne by the Customer.

Upon receiving the Products, the Customer is required to check the integrity of the Products and their quantity and quality. If any damage or shortage is detected, the Customer must report it to the courier and request an official report. Without an official report, the Service Provider assumes no responsibility for any subsequent shortage or damage unless it can be proven that it existed at the time of dispatch.

If the service is not delivered or delayed due to the fault of the courier service, the Service Provider is not liable for any damages incurred.

Consumer Information Based on Government Decree No. 45/2014 (II. 26.)

According to Section 8:1 of the Civil Code, Paragraph 1, only natural persons acting outside their trade, self-employment, or business activities qualify as consumers; thus, legal entities cannot exercise the right of withdrawal without justification.

The consumer is entitled to exercise the right of withdrawal: a) in the case of a product purchase contract:

  • within 14 days from the date of receipt of the product.

The right of withdrawal is considered exercised within the deadline if the consumer sends their declaration within the period.

If the consumer withdraws from the contract following Section 22 of Government Decree No. 45/2014 (II. 26.), the Seller will refund the full amount paid by the consumer, including the delivery fee, within fourteen days from the date of knowledge of the withdrawal. The consumer may choose to receive a voucher of equivalent value instead of a refund.

The consumer bears the cost of returning the product. The return is considered fulfilled on time if the consumer sends the product before the deadline.

The consumer may not exercise their right of withdrawal in the cases listed in Section 29 (1) of Government Decree No. 45/2014 (II. 26.).

Warranty for Defects, Product Warranty

The consumer has the right to exercise claims for defective performance under the Hungarian Civil Code and may use the statutory warranty or product warranty rights.

Liability

The information on the website has been published in good faith; however, it serves informational purposes only. The Service Provider assumes no liability for the accuracy or completeness of the information.

Payment Processing

Handled through the Barion system. The Service Provider does not receive the bank card details. The service is provided by Barion Payment Zrt., an institution under the supervision of the Hungarian National Bank, license number: H-EN-I-1064/2013.

Miscellaneous Provisions

Unauthorized use of any content on the website, including graphics, software solutions, and computer programs, is prohibited. The Enterprise does not belong to any code of conduct regulated by the law on unfair commercial practices with consumers.
